Updates: Last month Michael Sullivan pulled this item off the table and attempted to send it to full council WITH A RECOMMENDATION TO ADOPT. He had Carmen Ocasio’s support for some reason.
MAYOR JOSHUA GARCIA issued a statement in opposition to this order.
“Statement from Holyoke Mayor re. Order Submitted by Councilors Jourdain and Vacon regarding ‘Sanctuary City’:
Holyoke City Councilors Kevin Jourdain and Linda Vacon in June filed an order seeking to affirm Holyoke’s status as a non-sanctuary city. As I have stated previously, to my knowledge, there is no universally accepted definition of a ‘sanctuary city,’ and Holyoke is not — by any definition — a sanctuary city.
The order put forward by the two City Councilors also advocates cooperation with the Department of Homeland Security and directives from the federal government. I want to make clear that it is not up to the City Council to declare such a policy. That decision is up to the Mayor. I also want to make clear that we do not do the work of the Department of Homeland Security and ICE.
My administration’s position, as reflected in my reissuance of the 2014 Executive Order Relating to the Enforcement of Civil Immigration Detainers in January 2025, is clear: Holyoke police will not honor or enforce civil immigration detainer requests from Immigration and Customs Enforcement (ICE) or Customs and Border Protection (CBP) if a person would otherwise be released. This policy, originally established by former Mayor Alex B. Morse, is rooted in Massachusetts law, as affirmed by the 2017 Supreme Judicial Court ruling that local law enforcement cannot detain individuals solely for immigration violations.
My priority as Mayor is to ensure the safety and well-being of all Holyoke residents, regardless of their background. This includes fostering trust between our community and local law enforcement. I have expressed concerns that federal immigration actions, such as the recent Department of Homeland Security announcement allowing ICE and CBP to conduct operations in sensitive areas such as schools and churches, could undermine public safety by making residents hesitant to call 911 or cooperate with police due to fear of deportation.
On that note, Holyoke has a proud history of compassion and inclusion, welcoming newcomers and supporting those in need. This does not equate to sanctuary city status; rather, it reflects our commitment to humanitarian values while adhering to state and local laws. My administration is actively monitoring guidance from Governor Maura Healey’s office to navigate these complex issues, ensuring we balance our legal obligations with our moral responsibility to protect all residents.
The proposed order from the councilors is under review, and I look forward to engaging in further dialogue with the City Council and our community to ensure our policies reflect both our legal framework and our values as a welcoming city. Public safety depends on trust, communication, and cooperation, and I remain committed to upholding these principles.”

Jourdain, Vacon- Ordered, that the following Resolution of the City Council be adopted and a copy be transmitted to the Department of Homeland Security and our federal delegation and the White House. It shall also be used by all departments of the city with their applications for federal funds and grants when necessary. 1. Holyoke is not a sanctuary city. 2. Mayor Joshua Garcia has publicly declared that Holyoke is not a sanctuary city. 3. The City Council hereby declares Holyoke is not a sanctuary city. 4. Holyoke adopted Ordinance 2-68 “No elected official, department head or other city employee shall issue any order that shall knowingly violate any law or regulation of the federal, state or local government or the Constitution of the United States, the Constitution of the Commonwealth of Massachusetts or the Charter of the City of Holyoke, or any lawful order of a court of competent jurisdiction. No such order given shall be valid or shall be enforced by the City of Holyoke or its departments.” 5. To the extent, Holyoke has been deemed a sanctuary city by the federal government for failing to comply with any federal law or regulation, the Department of Homeland Security should notify the Holyoke City Council and Mayor of its specific violation and what steps are needed to remedy. 6. The City of Holyoke and all of its employees and agents hereby agree to fully comply with all federal laws and regulations. To the extent the city, its employees or agents have or are violating any federal law or regulation, they shall immediately cease and fully comply. 7. The City of Holyoke requests removal from any identification of our city as a sanctuary city by any federal department or agency.
The matter was moved to the ‘Development and Government Relations Committee’ which next meets on October 6 at 6:30pm (we gather an hour early)

Los concejales Kevin Jourdain y Linda Vacon presentaron en junio una orden para afirmar que Holyoke no es una ciudad santuario. Como ya he dicho antes, hasta donde tengo entendido, no existe una definición universalmente aceptada de lo que es una “ciudad santuario”, y Holyoke no lo es — bajo ninguna definición.
La orden también propone colaborar con el Departamento de Seguridad Nacional (DHS) y seguir directrices federales. Quiero dejar claro que no le corresponde al Concejo Municipal establecer esa política. Esa decisión le toca al alcalde.
Mi administración, como reflejo de la reemisión de la Orden Ejecutiva de 2014 sobre la aplicación de órdenes civiles de detención migratoria (enero 2025), mantiene una posición firme: La policía de Holyoke no cumplirá ni hará cumplir solicitudes civiles de detención por parte de ICE o CBP si la persona ya puede ser liberada.
Esta política fue establecida originalmente por el exalcalde Alex Morse y está basada en la ley de Massachusetts, como afirmó el Tribunal Supremo Judicial en 2017: las fuerzas del orden locales no pueden detener personas únicamente por violaciones migratorias.
